Treatment of alcoholism without the patient’s knowledge

License of the Ministry of Health of Ukraine dated 08.07.2020 No. 3197/L-P

Treatment of alcoholism without the patient‘s consent, also known as compulsory treatment, can be used in extreme cases when a person poses an immediate danger to his or her life or the lives of others and cannot make informed decisions due to alcohol intoxication. Compulsory treatment is a complex and controversial issue, as it can affect the boundaries of individual rights and freedoms. That is why the treatment of alcoholism without the patient’s knowledge is possible only in accordance with the legal norms and provisions of patient safety.

In what cases can treatment be performed without the patient’s knowledge

However, the law allows treatment without the patient’s knowledge in some cases, including:

  • State of critical danger – if a person is in a state of severe alcohol intoxication and his or her life is in danger due to the risk of respiratory failure, heart failure, or for another reason, medical specialists may decide on emergency hospitalization to prevent a fatal outcome.
  • Aggressive behavior – a person under the influence of alcohol becomes aggressive, violates public order or disobeys the rules for others, emergency measures may be taken to refer the patient for treatment.
  • Injury – a person who is intoxicated may attempt suicide or inflict serious bodily harm on themselves. If this is found to be the case, compulsory hospitalization may be recognized by the court as admissible to prevent a threat to the patient’s life.
  • Inability to give consent to treatment – a person in a state of intoxication is not able to make decisions about their health, and involuntary hospitalization can be justified if it is aimed at preserving the patient’s life and health.

It is worth noting that the necessary treatment of alcoholism without the patient’s knowledge must be carried out in strict accordance with the law and human rights. You should also be aware that using various drugs aimed at getting rid of alcoholism without the patient’s knowledge can be dangerous to their health and life. You should not try to help a person suffering from alcohol dependence out of the best of intentions. Any medication should be selected by a doctor taking into account the individual characteristics of the patient and the specifics of the disease in each case. Remember that the drug that helped your neighbor will not necessarily help your relative. Most likely, such self-treatment can be harmful and cause a worsening of the condition.
